California consumers have rights under the California Consumer Privacy Act (CCPA) regarding their personal information. These rights are explained below along with the ways you can exercise them. We also identify below the categories of personal information, subject to the CCPA, that Oportun collects about consumers and from whom, the purposes for which we use this information, and how long we keep it.

For the purposes of this notice and the CCPA, the term “consumer(s)” as used herein shall be understood to include all active or former applicants, employees or contractors of Oportun or its affiliates who reside in California.

We may collect the following personal information about consumers:

  • Personal identifiers, such as name, address, telephone number, email address, identification number, and other information we use to contact consumers
  • Characteristics of protected classifications, such as age, gender, military or veteran status, marital status, nationality, or citizenship
  • Fingerprints, voice prints, keystroke patterns and rhythms or other biometric information
  • Professional or employment information like title, salary, or references
  • Details of a consumer’s education and qualifications
  • Financial information like account numbers, transaction data, and demographic information associated with consumer financial accounts
  • Internet or other network activity related to any use of our website, including browsing history, search history, and interactions with applications or advertisements
  • Audio, electronic, and visual information, including phone calls recordings and security camera footage from our physical locations
  • Inferences drawn from any of the information we collect relating to customer preferences, behaviors, and creditworthiness to inform our business practices and products and to make determinations about products and services we may offer you
  • Sensitive personal information such as your racial or ethnic origin, religious or philosophical beliefs, or union membership

We collect the personal information identified above from or through a variety of sources, including the following:

  • You, we obtain personal information when you provide it to us by, for example, interacting with Oportun in our retail locations or on our website
  • Publicly available sources, we collect personal information that you manifestly choose to make public, such as via social media
  • Third parties, we receive personal information from third parties – including our members, credit reporting agencies, and law enforcement – who provide it to us

We keep your personal information for as long as it is reasonably required to deliver offers for, make available to you, or otherwise communicate with you about the Oportun products or services that we feel are suited to your financial situation.  Please visit our Online Privacy Policy for more details.

Oportun does not currently disclose or sell personal information to third parties other than as allowed by law.

Exercising your rights as a California resident

To exercise any of the rights described in the paragraphs that follow, you must submit your request using the form below or by calling 866-488-6090.  You can designate an authorized agent to make CCPA requests on your behalf. Please call the toll-free number if you wish to do so.

Once we receive your request, we will confirm receipt within 10 days and attempt to verify your identity. If we successfully verify your identity, or you’ve submitted a request that doesn’t require us to verify your identity, we will process your request, send you our response, or request an extension as required by law.

You have the right not to receive discriminatory treatment for exercising any of your privacy rights.

Request to know about Oportun’s personal information collection and handling:

You have the right to request details about the following, each as it relates to Oportun’s activities in the past 12 months:

  • the categories or specific pieces of personal information, not exempt under CCPA, that Oportun collects about you
  • the categories of sources from which the personal information is collected
  • the business or commercial purpose(s) for collecting or selling personal information
  • the categories of third parties with whom Oportun shares or sells personal information (which does not currently apply as Oportun does not share consumer personal information, subject to CCPA, with unaffiliated third parties)

Request for deletion of personal information:

You have the right to request that we delete any personal information, not exempt under CCPA, that we have collected from you. This right does not cover information that we have a legal obligation to maintain, information related to your current or former Oportun accounts, or information that has already been de-identified or aggregated.

To help ensure the integrity of our systems and databases, in lieu of deleting your personal information we may de-identify or aggregate it with other information such that it no longer identifies you.

Request for correction of personal information:

You have the right to request that businesses correct any inaccurate personal information, not exempt under CCPA, that they have about you.  In most instances, the nonexempt personal information that Oportun maintains about consumers comes from outside sources.  We are not in the best position to correct inaccurate personal information.  Requests to correct personal information – other than those from active or former applicants, employees or contractors of Oportun or its affiliates – will be processed as a request to delete from our records any of your personal information that is not exempt under CCPA.

Request to opt out of the sale of personal information or sharing of personal information for cross-context behavioral advertising:

You have the right to request that a business that sells your personal information stop selling your personal information, not exempt under CCPA, to third parties. This right encompasses circumstances in which a business shares your personal information with third parties for financial or nonfinancial consideration. You also have the right, as further defined in the CCPA and its implementing regulations, to direct a business that shares your personal information with third parties for cross-context behavioral advertising to stop doing so.  Oportun does not currently “sell” or “share” personal information as defined by the CCPA, but we will accept requests that we not do so.

Follow these steps to submit a request:

  1. Complete this online form or call 866-488-6090.
  2. Provide all of the following information or we will not be able to respond to your request:
    • Full legal name
    • Mailing address
    • Year of birth
    • Email address and telephone number
  3. Select one of the following requests:
    • Request to know the categories and specific pieces of personal information we collect about you, business or commercial purposes, and sources
    • Request to delete information we have about you.
    • Request to correct inaccurate personal information.  Please note that this will be processed as a request for deletion unless you are an applicant, employee, or contractor of Oportun or its affiliates.
    • Request to opt out of selling or sharing your personal information to third parties

Here are a few things to know about our responses:

  • To safeguard your personal information, we will not provide any sensitive personal information, such as your personal identification number or Social Security number, in our response since that may put your identity at risk.
  • Our responses will not include certain pieces of personal information that cannot be easily presented to you in paper or electronic format. For example, if we have your voice print on file, we will tell you we have a voice print for you but will not attempt to provide it to you.
  • Please remember your rights under the CCPA do not cover information related to your current or former Oportun accounts. Any information Oportun collects about you in connection with your application, or by servicing or collecting on accounts you have with us is exempt under the CCPA because it is covered by federal law, the Gramm Leach Bliley Act, and our Oportun Privacy Notice.
